These Terms of Service govern your access to and use of the Barrels of Scotch website, products, and services, including cask purchases, bonded storage, bottling, shipping, delivery, and related concierge services.

By accessing our website or placing an order with us, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should not use our services.

These Terms apply to all users of the website, including browsers, customers, account holders, and purchasers.

Eligibility

By using our website or placing an order, you confirm that:

  • You are of legal drinking age in your jurisdiction

  • You are legally permitted to purchase and receive alcohol products

  • All information you provide is accurate and complete

We reserve the right to refuse service, cancel orders, or restrict access where legal or compliance concerns arise.

Nature of Cask Ownership

Cask ownership is not a standard retail product purchase.

When purchasing a whisky cask through Barrels of Scotch:

  • Ownership of the cask is recorded in your name

  • The cask remains in bonded storage in Scotland at all times

  • The whisky continues to mature under regulated bonded conditions

  • Full casks are not physically delivered domestically or internationally

Scotch whisky must legally mature and be bottled in Scotland. Casks cannot be removed from bonded storage except for authorised bottling at licensed Scottish facilities.

Whisky maturation is a natural process and may result in changes to flavour, colour, character, and volume over time, including evaporation commonly known as “the angels’ share”.

Orders & Ownership Transfer

All orders are subject to acceptance and availability.

Ownership transfer and bonded registration processes begin after purchase completion.

Once ownership registration procedures have commenced, orders may no longer be cancelled except where expressly permitted under these Terms.

We reserve the right to refuse or cancel any order where required for legal, regulatory, fraud prevention, or compliance reasons.

Cancellation Policy for Cask Purchases

You may cancel a cask purchase within 48 hours of completing your order.

Where cancellation is requested within this 48-hour period, payments will be refunded in full.

After 48 hours, bonded ownership registration and transfer processes begin and cancellations are no longer available.

Bottling Services

Bottling only occurs upon your instruction.

Once a bottling order is confirmed:

  • Bottling orders become final

  • Production is arranged through licensed Scottish bottling facilities

  • Bottled whisky is classified as a bespoke product

  • Bottled products are non-returnable and non-refundable

Bottling orders placed online begin from six bottles and increase in multiples of six up to a maximum of 30 bottles per transaction.

For bottling quantities exceeding 30 bottles in a single release, our concierge team will coordinate the process directly.

There is no limit to how many times whisky may be bottled from your cask over its lifetime.

Any remaining whisky continues to mature in bonded storage until future bottling instructions are provided.

We strongly encourage customers to review all bottling details carefully before confirming an order.

Pricing & Payment

All pricing displayed on the website is shown in the applicable currency at checkout.

Payment must be made in full before ownership transfer, bottling, or shipment processes commence.

United Kingdom Deliveries

For deliveries within the United Kingdom:

  • Excise duty

  • VAT

  • Shipping charges

are calculated and displayed at checkout once bottling is confirmed.

No additional charges will apply beyond those shown during checkout.

International Deliveries

For deliveries outside the United Kingdom:

  • Import duties

  • Taxes

  • Customs charges

  • Local regulatory fees

are determined by the destination jurisdiction and remain the responsibility of the recipient.

International shipments are coordinated through our concierge service prior to dispatch.

Shipping & Delivery

General Shipping Conditions

Your cask remains stored in bonded facilities in Scotland at all times until bottling occurs.

Shipping only begins after whisky has been bottled.

Once bottled:

  • Bottles are professionally packaged

  • Compliance documentation is prepared

  • Shipment is arranged using specialist spirits couriers

Estimated delivery timeframe is typically 2–4 weeks following completion of bottling, although delivery timelines are estimates only and may vary.

International Shipping & Compliance

Due to varying international alcohol regulations, our concierge team may assist with:

  • Shipping eligibility confirmation

  • Customs documentation

  • Guidance regarding taxes and duties

  • Finalisation of shipping arrangements and delivery costs

While we provide guidance regarding international shipments, customers remain responsible for ensuring they are legally permitted to import and receive alcohol products within their jurisdiction.

We reserve the right to refuse shipment to destinations restricted by law or courier limitations.

Shipping regulations may change without notice. Shipment eligibility will always be confirmed prior to dispatch.

Insurance & Risk

All shipments are insured while in transit.

Risk in bottled products transfers to the customer upon dispatch from our shipping partners.

Recipients may be required to provide proof of legal drinking age upon delivery in accordance with local regulations.

Returns & Refunds

Bottled Whisky

Once whisky has been bottled from your cask, it is considered a bespoke product.

Accordingly:

  • Bottled whisky is non-returnable

  • Bottled whisky is non-refundable

This applies to both partial bottlings and full-cask bottling releases.

Damaged or Lost Shipments

If your shipment is damaged or lost during transit, please notify us promptly upon receipt or expected delivery.

All shipments are insured and we will work directly with our courier partners to investigate and resolve claims where appropriate.

Storage

All casks are stored within bonded warehouses in Scotland in accordance with applicable industry and regulatory standards.

Any applicable storage fees will be clearly communicated to you.

Resale Assistance

If you no longer wish to retain ownership of your cask, we may assist in facilitating a resale through our network.

However:

  • Resale prices are not guaranteed

  • Market conditions may fluctuate

  • Timing may impact achievable sale value

We act solely as a facilitator and do not guarantee liquidity, profitability, or investment performance.

Compliance With Local Laws

Alcohol import laws vary by jurisdiction.

You are solely responsible for ensuring:

  • You are legally permitted to purchase and receive alcohol

  • Importation complies with local laws and regulations

  • Any applicable duties or taxes are paid

We are not responsible for shipments restricted, delayed, confiscated, or refused by customs or local authorities.

Intellectual Property

All website content, branding, logos, graphics, text, images, and materials are owned by or licensed to Barrels of Scotch and are protected by applicable intellectual property laws.

You may not reproduce, distribute, copy, or commercially exploit website content without prior written consent.

Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential losses

  • We do not guarantee future cask value, appreciation, or investment returns

  • Natural maturation changes, including flavour development and evaporation losses, are inherent characteristics of whisky ageing and do not constitute defects

  • Delivery timelines are estimates only and are not guaranteed

Nothing within these Terms excludes liability where exclusion is prohibited by law.

Force Majeure

We are not liable for delays, failures, or inability to perform obligations caused by events beyond our reasonable control, including but not limited to:

  • Regulatory or legal changes

  • Customs delays

  • Shipping disruptions

  • Industrial disputes

  • Acts of nature

  • Government actions

  • Supply chain interruptions

Website Availability

We do not guarantee uninterrupted or error-free access to the website.

We reserve the right to modify, suspend, or discontinue any part of the website or services at any time without notice.

Changes to These Terms

We may update these Terms of Service periodically.

The latest version will always be published on our website and will take effect immediately upon publication unless otherwise stated.
